FAIRFIELD — A Fairfield man has been charged with a felony after authorities said they found him naked with a 13-year-old in an alley.

Timothy Chavez, 21, was charged with lascivious acts with a child. The criminal complaint in the court file said officers were called by the girl’s mother, who said she was looking for her after a party. The mother found her “naked, with a Hispanic male who was also naked. The male subject was on top of [the girl].”

Chavez put on his clothes and fled. Witnesses backed up the mother’s statement, and the girl told police “she had been drinking, had blacked out, and did not remember what happened.”

Police found Chavez laying beside railroad tracks, hiding. He ran when spotted, but was caught.

The district court ordered Chavez to have no contact with the girl or her family. He applied for, and was granted, a court-appointed attorney. No plea was entered in the state’s court database as of Wednesday afternoon.

The case is strikingly similar to one from 2016, in which police investigating a car parked on the Jefferson County Trail near 32nd Street found Chavez and a 13-year-old girl partially clothed. Chavez was charged with third degree sexual abuse in that case. He was convicted of lascivious conduct with a minor and given a deferred sentence and placed on probation for two years.

Chavez was ordered to comply with the state’s sex offender registry, where he is listed as a Tier 2 offender.

In August 2017 Chavez failed to show up for a a probation revocation hearing. He was found in contempt of court and given 90 days in jail. His probation on the earlier charge was continued.
