FAIRFIELD — A Jefferson County man arrested after authorities said he was found in an alley naked with a 13-year-old girl will be sentenced later this month.

Timothy Chavez, 21, was arrested in April on a charge of lascivious acts with a child. Court documents said the girl’s mother went looking for her after she failed to return home from a party. She found her daughter and Chavez, and he fled after being discovered.

The girl told police she “had been drinking, had blacked out, and did not remember what happened.” Police found Chavez hiding by railroad tracks and caught him after a brief chase.

Chavez was already on the state’s sex offender registry for a 2016 case that had strong similarities to the one from April. In that case police found Chavez and another 13-year-old, both partially clothed, in a car parked along the Jefferson County Trail. He was convicted of lascivious conduct with a minor and given a deferred sentence with two years’ probation.

Filings in the April case show the court was told Chavez “will be entering a plea.” It did not specify whether the plea was part of any agreement with authorities. Earlier filings had suggested Chavez planned to fight the case, including a waiver of his right to a speedy trial filed in late July.

Chavez’s plea and sentencing is scheduled for Aug. 12.
